This course will focus on issues for senior supervisory personnel involved in the management of the cooperative. The course will cover and address tax issues unique to the cooperative business model.

Cancellation Policy
Cancellations received three weeks prior to the start of the workshop are fully refundable. Cancellations received two weeks prior to the start of the workshop will be issued a refund minus a $175 cancellation fee. Substitutions are accepted. Cancellations the week prior and no shows are responsible for paying the full registration fee.

COURSE INFORMATION

Learning Objective: Identify and assess the tax risks involved in operating as a tax-exempt electric distribution cooperative in a changing business environment.

TOPICS TO BE COVERED

Tax Risk, including:
• IRC Section 501©(12) tax-exempt status - what it is and is not
• 85-15 test considerations and their role in the decision-making process
• Impact of failing 85-15 test
• Unrelated business income tax considerations for expanded business activities 
• Nonprofit, at-cost operation and patrons' equity - federal cooperative tax law, bylaws and patronage capital credit policy considerations
• Impact of regulatory assets and liabilities including deferred revenue
• Special reporting considerations
